{"id":82,"date":"2019-11-14T11:50:33","date_gmt":"2019-11-14T11:50:33","guid":{"rendered":"https:\/\/www.normsmanagement.com\/blog\/?post_type=ufaq&#038;p=82"},"modified":"2024-12-23T10:00:20","modified_gmt":"2024-12-23T10:00:20","slug":"employees-state-insurance-act-1948","status":"publish","type":"ufaq","link":"https:\/\/www.normsmanagement.com\/blog\/ufaqs\/employees-state-insurance-act-1948\/","title":{"rendered":"EMPLOYEES\u2019 STATE INSURANCE ACT, 1948"},"content":{"rendered":"\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<blockquote>\n<p><strong>Applies:<\/strong>To Factories, Shops, Establishments,Hospitals,<br>Education Institutions- If the employment strength on any day reached 10 or<br>more\u2002<\/p>\n<\/blockquote>\n<p><\/p>\n<p><strong>Wage ceiling for coverage of an employee <\/strong>Rs. 21,000\/-<br>(w.e.f. 01-01-2017)<\/p>\n<p><\/p>\n<p><strong>Percentage of contribution:<\/strong><\/p>\n<p><\/p>\n<p>Employee&#8211;0.75% of wages<\/p>\n<p><\/p>\n<p>Employer&#8211;3.25% of wages<\/p>\n<p><\/p>\n<p>Contribution on total wages except on T.A. and washing allowance.<\/p>\n<p><\/p>\n<p>No employee\u2019s share of contribution if his\/her average daily wages does not<br>exceed Rs. 176\/-<\/p>\n<p><\/p>\n<p>If the wages of an employee in a contribution period exceeds Rs. 21,000\/-<br>he\/she will continue to be covered till the expiry of that contribution period.<\/p>\n<p><\/p>\n<p>All Employees have to be registered within 10 days from the date of their<br>appointment.<\/p>\n<p><\/p>\n<p><strong>ESI Act Implemented all over Kerala<\/strong> w.e.f. 01.02.2017<\/p>\n<p><\/p>\n<p>Books of Accounts, and other connected records to be preserved for 5 years<br>for inspection<\/p>\n<p><\/p>\n<p><strong>In the newly implemented areas<\/strong> for the initial 24 months<br>from the date of implementation, Employer\u2019s Contribution- 3% of wages.<\/p>\n<p><\/p>\n<p>Employee\u2019s Contribution- 1% of wages. On completion of 24 months general<br>rates will apply.<\/p>\n<p><\/p>\n<p><strong>Due date of contribution:\u2002<\/strong>15th of every month (w.e.f.<br>15.07.2017)<\/p>\n<p><\/p>\n<p><strong>BENEFITS UNDER ESI ACT<\/strong><br><strong>Medical Benefit<\/strong><br>\u2022 From the first day onwards- To the family also<br>\u2022 No contributory condition for ordinary treatment.For Super Specialty treatment-<br>For employee 6 months service and for his dependants one year service. Medical<br>Benefit to Insured Person who leaves employment<br>\u2022 Should have been in insurable employment at least for 5 years.<br>\u2022 Admissible to InsuredPerson &amp; to his\/her spouse.<br>\u2022 Contribution@Rs.10 per month. Sickness Benefit<br>\u2022 70% of wages for each day of abstention from duties due to sickness<br>\u2022 For 91 days in an year Extended Sickness Benefit<br>\u2022 Eligible for 34 notified long-term diseases<br>\u2022 Upto 730 days during a period of 3 years<br>\u2022 80% of wages for each day of abstention from duties due to long term sickness<\/p>\n<p><\/p>\n<p><strong>Enhanced Sickness Benefit<\/strong><br>\u2022 For family planning operations<br>\u2022 For women 14 days full wages.
